Notification of violations

Benhauer sp. z o.o. with its registered office in Krakow (operator of the SALESmanago system) has established the following e-mail address as a contact point for Member State and European Union authorities and recipients of our services, for the purpose of applying the Digital Services Act:

Benhauer sp. z o.o. accepts notifications in this respect made in Polish and English.

Benhauer sp. z o.o. allows to report the presence in the SALESmanago system of information that an individual or entity considers to be illegal content, using the form below.

Notify of violation

  1. The data controller of your personal data is Benhauer sp. z o.o. based in Cracow, Stanisława Klimeckiego 4, entered in the Register of Businesses maintained by Division XI of the National Court Register of the District Court for Kraków-Center in Kraków under KRS number 0000523346, REGON number 122334666 and NIP number 6762447754 (hereinafter referred to as “Benhauer” or “the controller”).
  2. The personal data provided in the form will be processed:
    • a. for the purpose of fulfilling obligations imposed on the Controller under applicable laws, in particular under Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC (Digital Services Act) (Article 6(1)(c) GDPR),
    • b. for the purpose of possible investigation as well as defense of claims, which is a legitimate interest of the Controller (6(1)(f) GDPR).
  3. Personal data may be made available to entities authorized by law. Entities supporting the Controller, among others in the field of IT services, may also have access to the data on the basis of relevant contracts.
  4. Personal data will be stored for the period required by applicable laws or until any claims expire, whichever is later.
  5. Provision of personal data is obligatory, unless the notification concerns information considered to be related to one of the crimes referred to in Articles 3-7 of Directive 2011/93/EU.
  6. Personal data will also be processed using tools/systems provided by entities supporting the Controller that are based or process data outside the European Economic Area. In this case, personal data is transferred on the basis of standard contractual clauses approved by the European Commission or a decision of the European Commission stating an adequate level of protection in a given country, e.g. under the EU-US Data Protection Framework.
  7. The Controller does not make decisions based on automated processing, including profiling (with respect to the purposes of data processing described above).
  8. You have the right, as applicable, to:
    • a. request access to your personal data, rectification, deletion and restriction of processing, and if your personal data is processed in an automated manner on a contractual basis, you also have the right to portability of your personal data;
    • b. object to the processing of your personal data - when your data is processed on the basis of the legitimate interest of the Controller;
    • c. lodge a complaint to the supervisory authority (PUODO - President of the Office for Personal Data Protection 2 Stawki Street, 00-193 Warsaw, email: kancelaria@uodo.gov.pl).
